Terms of service

These Terms of Service (the “Terms”) govern your access to and use of the Verre Jaune website at verrejaune.com (the “Site”) and the products, services, and content offered through it (collectively, the “Services”), operated by Verre Jaune (“Verre Jaune,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About Verre Jaune

Verre Jaune is a Quebec-based business that designs and sells original art-driven graphic apparel. Products are produced on demand through third-party fulfilment partners and shipped directly to customers.

Our designs are original works of parody, commentary, and cultural reference. They are not affiliated with, endorsed by, sponsored by, or connected to any person, brand, team, franchise, or rights-holder that a design may evoke. Any names or likenesses that may come to mind are referenced solely as commentary and cultural expression.

2. Eligibility

To purchase from the Site, you must be at least 18 years of age (or the age of majority in your jurisdiction) and able to enter into legally binding contracts.

3. Products and orders

All product descriptions, images, and prices on the Site are provided for informational purposes and may be updated without notice. We reserve the right to limit quantities, refuse or cancel any order, and correct pricing or product errors at any time, including after an order has been placed. If we cancel an order, we will refund any amount charged. Each design is produced in limited runs. Once a run is sold through, the design is moved to our archive (“the vault”) and may or may not be reissued at our discretion.

4. Pricing, payment, and taxes

Prices are displayed in the currency of your selected market. Applicable taxes and shipping costs are calculated and disclosed at checkout. Payment is processed at the time of order through our payment provider.

5. Shipping and delivery

Orders are produced on demand and shipped from our fulfilment partner’s facilities. Production and shipping timelines are estimates and are not guaranteed. Title and risk of loss pass to you upon delivery to the carrier. We currently ship to addresses in Canada and the United States. Customs duties, import taxes, or similar fees that may apply to international orders are the responsibility of the recipient.

6. Returns and exchanges

Because each item is produced on demand, we accept returns or exchanges only for items that arrive damaged, defective, or incorrect (wrong product shipped). Claims must be submitted to info@verrejaune.com within 30 days of delivery, with photo documentation. We will replace the item or issue a refund. Full details are set out in our Return & Refund Policy. Care instructions are provided with each product; we are not responsible for damage resulting from improper care. This section does not limit any non-waivable consumer rights you may have under applicable law, including the Quebec Consumer Protection Act.

7. Intellectual property

All content on the Site, including designs, illustrations, photographs, text, logos, and the Verre Jaune name and visual identity, is owned by Verre Jaune or used with permission. You may not reproduce, distribute, modify, or create derivative works from any of this content without our prior written consent, except for personal, non-commercial viewing. Purchase of a product entitles you to ownership of the physical item only. It does not transfer any rights in the underlying design.

8. Acceptable use

You agree not to use the Site to engage in any unlawful activity, to interfere with the Site’s operation, to attempt unauthorized access to any system, or to harass any other user or our staff.

9. Third-party services

The Site integrates with third-party services for payment processing, fulfilment, email delivery, and analytics. Your use of those services is subject to their respective terms. We are not responsible for the practices of third-party services.

10. Disclaimers

The Site and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, except those that cannot be excluded under applicable consumer-protection law.

11. Limitation of liability

To the maximum extent permitted by law, Verre Jaune’s total liability arising from or related to your use of the Site or any product purchased through it is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits any liability that cannot be excluded under applicable law.

12. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted to the Site. Continued use of the Site after changes are posted constitutes acceptance. We will indicate the effective date of the current version at the top of the page.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in Quebec. Any dispute arising from these Terms or your use of the Site is subject to the exclusive jurisdiction of the courts of Quebec, without prejudice to consumer rights under applicable law.
